A) Terms and Conditions

1. Treatment Approach of Health Point Dr. Klein AG

The Health Point Dr. Klein success concept is a holistic treatment approach known as "biological or functional medicine"—a treatment based on nature-inspired concepts and remedies. It not only involves therapy using natural remedies but also specifically stimulates the body's self-healing abilities and requires a thorough examination of one's current lifestyle and health situation.

For us, a holistic approach means viewing each person as a unique individual and recognizing the connections between body, mind, and spirit. This involves close collaboration between our medical practice and holistic dentistry. A thorough assessment of the patient’s oral health is an integral part of our treatment approach. We focus on treating the root cause rather than merely addressing the symptoms!

2. Health Insurance Billing

Dr. Klein and Partners are available exclusively as private practitioners. This means we can offer you ample time for your consultation. However, you cannot submit your bills from Dr. Klein to health insurance companies; for additional staff, you may be able to submit them to supplemental insurance providers. Please see the note under “TEAM” for more information. We are happy to provide you with receipts for tax purposes.

3. Procedure and Rules

Dr. Klein and Partners will be responsible for your care from the start of treatment and will be available to address any medical concerns you may have. They will explain the exact course of treatment and any potential risks to you. Medical records can be requested by the patient from their primary care physician or hospital. You grant us permission to transmit the requested data to your health insurance provider’s medical examiner.

1. Scope

These General Terms and Conditions (GTC) apply to all services provided by Health Point Dr. Klein AG and to all legal transactions with Health Point Dr. Klein AG. They form an integral part of the respective contractual relationship between Health Point Dr. Klein AG and the client. Amendments and side agreements are effective only if confirmed in writing by Health Point Dr. Klein AG.

In all other respects, the provisions of the Swiss Code of Obligations (OR) and other Swiss laws and regulations shall apply. Should any provision of these General Terms and Conditions be or become invalid, or should the contract contain a loophole, the legal validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely approximates the economic intent of the parties, as if it had been agreed upon from the outset. The same applies in the event of a loophole.

2. Services

For the purposes of these Terms and Conditions, the following are considered services: treatments, consultations, evaluations, analyses, therapies, etc.

3. Placing an Order

After completing our digital questionnaire, the client can request a non-binding cost estimate for an outpatient or inpatient stay. This quote includes medical services but does not include external services such as laboratory tests, medications, X-rays, accommodation, meals, etc.
In biological medicine, the treatment plan is tailored individually to the client and can therefore only be finalized on-site. Consequently, the final invoice may differ from the cost estimate. By signing the Terms and Conditions, the contract or order is concluded, and the client acknowledges the Terms and Conditions and confirms that they have read them.

4. Identity of the contracting party

5. Dates

Health Point Dr. Klein AG undertakes to provide the agreed services to the service recipient on the dates specified in the order confirmation, while the client undertakes to accept these services during the specified period.

The dates will be postponed appropriately if circumstances arise that are beyond the control of Health Point Dr. Klein AG, such as natural disasters, mobilization, war, civil unrest, epidemics, accidents, and illness, significant operational disruptions, labor disputes, delayed or defective deliveries, and government measures.

If an outpatient client fails to keep an appointment, you will be billed for the corresponding cancellation fees in accordance with the applicable billing policy, unless the appointment was canceled at least 24 hours in advance.

In the event of other delays, the client may

a) opt out of further services: He must notify Health Point Dr. Klein AG of this immediately.

b) Request partial deliveries, if possible: This must be agreed upon immediately.

c) grant Health Point Dr. Klein AG a reasonable period of grace for subsequent performance: If Health Point Dr. Klein AG fails to perform by the end of this grace period, the Client may, provided it gives immediate notice, waive the right to subsequent performance or withdraw from the contract.

Health Point Dr. Klein AG must notify the client of any delays as soon as possible. Any damages will be calculated in accordance with Article 191 of the Swiss Code of Obligations.

6. Terms of Payment

The costs are set forth in the quotation, subject to reasonable variations. It is also noted that costs for third-party services (particularly laboratory tests) and pharmaceutical products are not included and will therefore be charged separately. Service fees requested separately by the client are due immediately upon fulfillment without deduction. If payment terms are not met, Health Point Dr. Klein AG is entitled to

a) To immediately issue invoices to the client

b) and/or to perform any outstanding services only upon receipt of advance payment.
If the client fails to meet the payment deadlines after the second reminder, the client shall be required to pay default interest from the due date at a rate of 5% in accordance with Swiss Code of Obligations (OR) § 104(1).

For inpatient stays of one or more weeks, an advance payment of CHF 2,000 is required, regardless of the patient’s country of origin. For all patients from abroad, the above-mentioned advance payment is mandatory, regardless of the length of stay. If treatment is not commenced, a cancellation fee of CHF 1,000 will be charged. The following cards are accepted: Maestro, Visa, and MasterCard.

7. Warranty

Health Point Dr. Klein AG is committed to exercising due care and providing high-quality services. It further undertakes to carefully select the parties it engages (hotels, etc.) and to monitor them to the extent of its professional expertise. The company guarantees that the agreed-upon services will be performed with due care and in accordance with the current state of science and teaching, as well as its many years of experience.

8. Data Protection

Health Point Dr. Klein AG treats client data as confidential in accordance with data protection laws. The data is used solely for internal processing and will not be disclosed to third parties without the patient’s consent. Only data necessary for the fulfillment of orders is collected.

9. Jurisdiction

These Terms and Conditions are governed by Swiss law, specifically the provisions of the Swiss Code of Obligations. The place of jurisdiction is 9052 Niederteufen AR.

10. Consent, Authorization, and Contractual Agreement

I have read and understood the information provided. I agree to the procedures described and authorize Health Point Dr. Klein AG to request records or provide information if necessary or upon request, and within the scope of the circumstances described.
